Terms of Service
Last updated: 5 October 2026
These terms govern your use of thethoughtcounts.com and your purchases from it. By using the site you agree to them. The service is operated by Altum Valorem Limited (trading as The Thought Counts), registered in England & Wales, company number 12413608.
Who can use the service
You must be 18 or over. By using the site you confirm that you are.
Your chat, your responsibility
- You confirm you have the right to upload the chat you use, in plain terms, it’s a conversation you are part of, and making a private keepsake from it won’t wrong the other people in it. A gift for the other person in the chat is the intended use; publishing someone’s private messages is not.
- You must not upload content that is unlawful, or use the service to harass, expose or embarrass anyone. We may refuse or cancel orders that appear to do so, with a refund.
What we make, and who owns what
- Your messages remain yours. You grant us a limited licence to process the excerpts you send us solely to create, correct and deliver your keepsake.
- Our template designs, brand and site remain ours. Your finished keepsake is yours to keep, print and gift for personal use.
- Keepsake content is generated with the help of AI from your own chat; numbers and quotes come from the chat itself. Review your preview before buying - what you approve is what we print.
Prices and payment
Prices are shown before you pay, in pounds sterling (with local currency shown where available), and include VAT where applicable. UK delivery is included in the framed print price; international delivery options and any costs are shown at checkout before payment. Payments are processed by Stripe. There are no fees beyond those shown at checkout.
Delivery and digital content
- Digital keepsakes are delivered immediately after payment.
- Framed prints are made to order by our print partner and typically delivered within 4 to 8 working days in the UK, slightly longer internationally.
Cancellations, returns and faults
See our Refund Policy. In short: personalised items are exempt from change-of-mind returns under UK law, digital content is delivered immediately with your consent, and anything faulty, damaged or not as previewed is replaced or refunded.
The Gifting Club
The Gifting Club is an annual subscription billed yearly through Stripe. You can cancel any time from the link in your receipt or by emailing us; cancellation stops the next renewal. Statutory cancellation rights apply to the initial purchase as described in the Refund Policy.
Buying from outside the UK
We deliver to several countries, and printed keepsakes are produced in or near your region by our print partner, so you shouldn’t face import charges. Nothing in these terms excludes or limits any consumer rights that the law of your country of residence gives you and does not allow to be excluded, for example, the consumer guarantees under the Australian Consumer Law. Where such mandatory local rights apply, they sit alongside these terms.
Our liability
Nothing in these terms limits liability that cannot be limited under UK law (including for death, personal injury caused by negligence, or fraud). Otherwise, our total liability for any order is limited to the amount you paid for it. We are not liable for losses that are not a foreseeable result of our breach.
General
These terms are governed by the law of England and Wales and its courts have jurisdiction (if you live in Scotland or Northern Ireland, you may also bring proceedings there). If any part of these terms is found unenforceable, the rest still applies. Questions: hello@thethoughtcounts.com.
